By accessing the materials/documents on the SailWeek Academy website, you agree to the following terms.

These booking terms govern your contract with SailWeek Limited (company number 08245801), of 2nd Floor, Nucleus House, 2 Lower Mortlake Road, Richmond, England, TW9 2JA, United Kingdom. SailWeek Academy is part of SailWeek Limited.

By using our services and taking advantage of these, you expressly agree to booking terms and conditions. If you do not accept these terms and agreements, you are prohibited from the use of all our services, including the use of our website and the services offered there.

Please read the following terms and booking conditions carefully and completely before you make a booking.

Definitions and interpretation

In these Booking Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

• • "We", "Us", "Our" — SailWeek Limited, as identified above.
• • "You", "Your" - Person named on the application form
• • The headings used in these Booking Terms and Conditions are for convenience only and shall have no effect upon the interpretation of these Terms and Conditions
• • Words imparting the singular shall include the plural and vice versa and references to any gender shall include the other gender
• • Your booking contract is formed when we accept your application in writing and receive the booking deposit.

Making a booking

To make a full booking, you must complete the application form on our website. With the completed application form, you agree to the following explicit:

• • All ‘’terms of reference'’ of our web pages are to be understood as an invitation to make an offer (invitation ed referendum)
• • By completing and submitting the application form an offer to conclude a contract will be sent to SailWeek Academy

SailWeek Academy will contact you as soon as possible to:

• • confirm the availability of your reservation
• • to inform you about the final price of the booked services
• • to name the due date for the payment of the deposit and
• • to send a detailed payment plan.

Prices and payment

Until the final confirmation on your booking, we reserve the right to change the total price of your services. Any price change is communicated to you without delay. We will not change an existing booking's agreed terms or price without your written agreement, except where a change is required by law. We will explain any required change before it takes effect.

The course price is paid in three instalments. The €100 first instalment is the booking deposit and forms part of the total course price. • First instalment: €100, due within 48 hours of receiving your booking confirmation and invoice. • Second instalment: half of the remaining course price, due 35 days after the first instalment. • Final instalment: the other half of the remaining course price, due 30 days before the course starts. If the normal instalment schedule would make the second instalment fall after the final payment deadline, the full course price is due in one payment within 48 hours of receiving your booking confirmation and invoice, and before the course starts. Applications accepted within 30 days before the course starts also require full payment in one payment. Your booking confirmation and invoice will state the payment method, amount and exact deadline that apply to your booking.

Payments can be made via Credit/Debit MasterCard/Visa. SailWeek does not store, nor does it have access to your credit card information, bank account numbers or other account data sent to those processing services.

Changing or canceling your booking

We will tell you promptly about any material change to your confirmed course.

If you do not accept that change, you may cancel and receive a refund for services not provided.

Cancellation by SailWeek Academy

If we must cancel because circumstances genuinely beyond our control make the course impossible to provide, we will explain the reason in writing.

You may choose an agreed equivalent course or receive a refund of payments for services we cannot provide.

We may end your participation for a serious breach of these terms. Where safe and practicable, we will explain the issue and give you an opportunity to remedy it. An immediate safety threat may require removal at the next safe port. Any retained payment must reflect reasonable losses; there is no automatic forfeiture of all payments.

Cancellation by you

When you commit to attend our Academy courses, we book yachts and make other financial commitments to skippers and sundry suppliers in order to be able to provide you the best possible sailing courses.

If you need to cancel, we will need to charge you a cancellation fee in order to offset financial obligations we have taken on to serve you. Because of that, we recommend you purchase travel insurance with cancellation cover. It can be bought by all major insurance companies.

The cancellation fee is the total value of all instalments due at the time we receive your written cancellation. Any charge will not exceed our reasonable net loss caused by your cancellation, taking account of costs saved and any resale. We will explain the calculation and refund any excess already paid.

If you decide to cancel your booking, inform us as soon as possible. Cancellation takes effect when SailWeek receives your cancellation in writing.

Flights, passports and visas

Before departure, you are responsible for having valid travel documents for every country you visit, including transit stops. Check the applicable passport, visa, immigration and health entry requirements for Croatia and any transit countries before you travel.

We do not accept any responsibilities if you cannot travel. You have agreed to reimburse us in relation to any fines or other losses which we incur as result of your failure to comply with any passport, visa, immigration requirements or health formalities.

Any arrangements or compensation in the event of a delay or cancellation will be at the sole discretion of the airline you booked with or your personal travel insurer.

Travel insurance

You must arrange suitable travel and health insurance covering sailing and treatment abroad. Insurance requirements do not remove our responsibility for services we provide. We do not exclude liability for our negligence causing death or personal injury, fraud, or other liability that cannot lawfully be excluded.

You shall ensure that your personal health insurance covers the risks associated with the booked service and has validity for claims abroad.

Sailing is considered by many health insurances as a risk sport and evaluated separately. You should be aware of the scope and coverage of your health insurance policies. We recommend an appropriate consultation with your insurance company prior to the booking.

Participant conduct

The following conduct may lead to cancellation of your participation:

• • Threatening yourself or others;
• • Causing injury;
• • Violating local or international laws;
• • Causing public unrest or persistently disturbing other participants; or
• • Conduct likely to result in any of the above.

We may end your participation for a serious breach of these terms. Where safe and practicable, we will explain the issue and give you an opportunity to remedy it.

Liability

We do not exclude liability for our negligence causing death or personal injury, fraud, or other liability that cannot lawfully be excluded.

Nothing in these terms excludes or limits liability where doing so would be unlawful, or affects your statutory rights.

Images and video

Marketing use of photographs and videos in which you are identifiable requires your separate, optional consent. This choice does not affect your booking.

Optional marketing consent: “I agree that SailWeek Limited may use photographs and videos in which I am identifiable to promote SailWeek Academy on its website, social media and marketing materials. This choice is optional and does not affect my booking. I can withdraw consent for future use by contacting info@sailweekacademy.com.”

Changes to these terms and governing law

A revised website version applies to future bookings. We will not change an existing booking's agreed terms or price without your written agreement, except where a change is required by law. We will explain any required change before it takes effect. Any disputes arising out of your use of this site or these terms and conditions shall be governed and controlled under and subject to English law and the non-exclusive jurisdiction of the English courts.

We use the personal information you provide to assess and respond to your Academy application and, if accepted, administer your booking. Where this is necessary to take steps at your request before entering a contract or to perform our contract with you, we rely on that contractual basis. Any optional marketing use requiring consent will be requested separately. Contact info@sailweekacademy.com about your personal data.

You may request deletion of your personal data by contacting info@sailweekacademy.com. We will consider your request in accordance with applicable data-protection requirements, including any legal obligation to retain records.

Privacy policy, cookies policy

Cookies are text files of a small size, often encrypted, that a website stores on a computer or other device when accessing the website. Cookies may store the identification of the user that visited the site and the places that were navigated.

When you revisit the site the cookies may be read in order to identify the user and to set the preferences and browser settings for that user. Failure to allow the use of cookies means that certain services or functionality of the website will not be available to the user.
